The third prohibited practice is about AI systems which evaluate or classify people or groups of people over a period of time based on their social behaviour and personal/personality predictions. If the social score leads to either detrimental or unfavourable treatment in unrelated social contexts for people or groups of people or detrimental or unfavourable treatment which is unjustified or disproportionate compared to their social behaviour, then the AI system is prohibited. [[Article 5]](1)(c) [[Recital 31]] explains this prohibition. Social scoring systems can lead to discriminatory outcomes and exclusion of certain groups, violating their right to dignity and non-discrimination. The use of social scores in unrelated contexts to where the data originated or which lead to detrimental treatment should be prohibited. This prohibition does not concern lawful evaluation practices of people for specific purposes in line with applicable law.
